Healthnut Ltd is a Wrexham based company that produces a wide range of health foods.The company has been highly successful in the UK and plans to export its production to continental Europe.Three products in particular have been identified for this export market:-
- Goats cheese containing preservatives;
- Goats milk packaged in rectangular cartons;
- Organic muesli made primarily from oats and fruit.
These products sold well and were particularly successful in Sweden.However recently the following events have occurred:-
Sweden has imposed a ban on ‘public health grounds’ on all dairy products to which preservatives have been added.This is despite scientific research claiming that the preservative used in the goat’s cheese is perfectly safe.
New Swedish law has also prohibited the use of the term ‘cheese’ to any cheese not made out of cow’s milk.
The first shipment of products was subject to lengthy delays at the Swedish ferry port whilst spot checks for health reasons were carried out.This involved opening half the cartons in every fourth case.Payment was required for this inspection and parking fees were imposed on the trucks.
In fact the goat’s milk was impounded and never reached its destination because Swedish law prohibited the selling of goat’s milk in anything but circular cartons.
The organic muesli has fared little better because Sweden has recently imposed a tax on all oat based cereals.However Sweden does not produce domestically made muesli.
Advise Healthnut Ltd as to whether EC law regarding the free movement of goods has been broken in each of the above scenarios
