【摘 要】：近年来,在互联网领域出现的“人肉搜索”现象,已经受到人们越来越多的关注.一方面,
“人肉搜索”具有一定的社会舆论监督意义,另一方面,其通常是一个群体针对某个人进行所谓的道德
审判,往往会涉及侵害个人的隐私权以及侵犯公民的其他正当权益.“人肉搜索”现象虽在一定程度上
体现了民众追求社会公平正义的意识,满足了公民对信息批露的公开公正的要求,但在人肉搜索过程中
的不适当的行为很容易导致侵犯他人的隐私权.因此,为了保护公民合法权益的同时,发挥“人肉搜索
”的正面的作用,对其加以理性的约束具有重要的理论和现实意义.“人肉搜索”行为应该纳入有序的
法律规范的范围,法律应该给“人肉搜索”一个适度合理的框架,使得“人肉搜索”的群体行为不至于
越出基本边界而侵犯公民自由和个人隐私.
