Mr Oldasnew is an antique dealer.He always gives his antiques to Jane to sell on
commission and on his behalf to prospective purchasers.On one single occasion
Simon was advised by Mr Oldasnew that Jane sells antiques for and on behalf of
Mr Oldasnew and has the authority to receive the sale proceeds.
On the 30th September 2009 Mr Oldasnew changed the terms of his long standing
arrangement with Jane.From that date thereof,Jane is not allowed to receive
payments for any antiques sold for Mr Oldasnew.Jane is obliged to inform the
customers of such new arrangement prior to any transaction.
Simon bought some of Mr Oldasnew’s antiques from Jane on the 31st September
2009.Upon the receipt of the purchase price,Jane disappeared.On the 2nd
October 2009,Mr Oldasnew located Simon and requested him to return the
antiques he received from Jane on the 31st September 2009.
You are Simon’s solicitor and he comes to you for advice.Does Simon have
to return the antiques to Mr Oldasnew?Advise Simon of his legal rights.

从国内法的角度来说,这个案例的关键点在于“Jane is obliged to inform the customers of such new arrangement prior to any transaction.”就是和Simon先生交易的时候,Jane是否已经提前告诉了他这个信息,如果告诉了,那么
Oldasnew先生是可以向Simon先生追要相应的财物的.如果Jane没有告诉,那么Simon先生可以认为她是有权的,Jane女士构成表见代理,Simon先生是为善意第三人,不承担返换财物的义务,Oldasnew先生只能向Jane女士追偿.
