社区矫正在我国兴起和发展尚不足十年时间,作为与监禁刑相对应的行刑方式,符合了现实和刑事政策依据,具有公正、人道和效益价值.《中华人民共和国刑法修正案八》于2011年2月25日通过,自2011年5月1日开始施行,社区矫正制度被正式纳入刑法,成为一项法定的行刑方式,对我国刑罚执行方式的发展更具有里程碑式的意义.但是,我国社区矫正仍存在适用率偏低的问题,这有立法方面的原因,社区矫正机制方面的原因,还有思想认识方面的原因等.因此,对社区矫正制度存在的问题进行系统的探讨,具有重要的理论价值和现实意义.
除引言和结论外,全文共分四章.第一章,从社区矫正制度的概念和特征入手,结合社区矫正制度的历史考察,总结我国社区矫正制度在试点工作成功经验基础上的模式选择.第二章,简要介绍社区矫正制度的域外发展状况.第三章,重点分析我国社区矫正制度目前存在的问题.第四章,针对前一章总结出的问题提出完善我国社区矫正制度的建议.

The community correction 's rise and development in China is still less than ten years imprisonment,as with the corresponding execution mode,accords with the reality and the criminal policy basis,with justice,humanity and benefit value." PRC Criminal Law amendment passed in February 25,2011 eight",since the May 1,2011 start implementation,community correction system was formally incorporated into the criminal law,as a legal form of execution in our country,the way of penalty execution development has the sense of milepost type.However,China 's community correction is still applicable rate lowly,the legislative reasons,the community correction mechanism reasons,and ideological reasons.Therefore,the community correction system existing problem of systematic research,has the important theory value and the practical significance.
Besides the introduction and conclusion,the thesis consists of four chapters.The first chapter,from the community correction system the conception and characteristics of community correction system,combined with the historical investigation,summed up China's community correction system in pilot job success experience based on mode selection.The second chapter,introduces the overseas development situation of community correction system.The third chapter,focuses on the analysis of community correction system in China at present existing problems.The fourth chapter,according to the former chapter summarizes the problem put forward to perfect the proposal of China's community correction system.
