实施依法治国的今天我国传媒与司法的关系已经受到人们越来越多的关注.一方面司法界要求司法独立的呼声日益高涨,另一方面新闻界对司法的监督与干预也日益加强.司法独立左右一线现在法治过肩普遍承认和确立的基本法律准则,是司法机关独立形式,司法机关形式司法权只能服从法律,严格按宪法和法律的规定办事,不受其他任何因素的干扰和影响.媒体对司法的监督意味着公众要通过报刊、杂志、广播电视等媒介对司法领域的事件,发表自己的看法、一件或言论,让这些事件接受广大公众的参看和督促,引起广大公众的关注,以委会社会的公平正义和良好秩序.司法向媒体公开,接受媒体监督,并建立司法信息公开制度,是我国司法民主的标志.
媒体是让公众了解公共信息和发表意见的主要渠道,媒体的监督对司法独立有促进作用,蛋同时媒体和司法之间也存在着冲突.本文从媒体监督和司法独立之间的冲突出发,结合二者之间的关系,提出一些针对性的措施,来平衡二者这件的关系：一是司法应对媒体监督的措施,而是媒体应建立规范的媒体监督制度机制.
