The Notice of Pending Appeal(AIT 11) is acknowledgement that your appeal has been registered by the AIT.
The Entry Clearance Office(CEO) at the British Mission (Embassy) Overseas where you made your original application will reconsider the original decision .If they decide you should be given a visa they will contact you.If they decide that the original decision should stand they will begin to prepare and send the evidence on which they based their decision to refuse your application to us.
The ECO is allowed time to explain the reasons they refused your application and to provide evidence known as ' the bundle ' to support their decision .If you lodged your appeal with the ECO this may take up to 16 weeks .If you lodged your appeal direct with the AIT this may take up to 19 weeks .
The date we expect to receive the bundle is printed on the AIT 11 notice.It is important to realise that this date is not a hearing date.
Once we receive the bundle or when the date we expect to receive the bundle from the ECO has passed ,we aim to arrange your appeal hearing at the next available date after a 4 weeks submission period if you are a family visitor or 8 weeks later for other cases .This submission period is given to allow you or your representative time to prepare your appeal or to discuss your case.
Please note that due the Data Protection Act 1998 the AIT can usually only accept changes to an appeal from the appellant and their representative.
To ensure the security of your appeal we are unable to accept these changes over the telephone.
The Tribunal directs that you file by 15 August,2007,a copy of the notice of decision to which the Notice of Appeal relates ,and any other document giving reasons for that decision ,together with any application from,record of interview ,or any other unpublished document to which you rely upon.
You must serve ,on the appellant ,a copy of all the documents ,expect for documents which you have already sent to Appellant.
